Decency clause still haunts the NEA Essay We have been engaged over the last four years, since the emergence of Robert Mapplethorpe and Andres Serrano as apparent threats to the Republic, in an extended battle, both in the Congress and in the Executive Branch, over the development of standards designed to contain or scourge dangerous or subversive ideas from arts projects supported by the government. We are all aware of the repeated attempts by Senator Helms, the Robespierre of American cultural affairs, to impose content restrictions on federal funding in the arts. By and large these restrictions have been beaten back in Congress, with the current exception of the so-called decency clause, passed in November 1990, which provided that grant applications to the National Endowment for the Arts are to be judged taking in consideration general standards of decency and respect for the diverse beliefs and values of the American public. That standard was challenged in a case involving Karen Finley, Holly Hughes, John Fleck and Tim Miller. The case had two major elements. The first, which has been recently settled, alleged that the NEA denied grants to these artists on political grounds, not on the grounds of artistic merit. And there has been some clear evidence of the fact that NEA chairman John Frohnmayer nixed these applications on political grounds, with the support of the President. That part of the case recently was settled with a $250,000 payment by the government; $50,000 of that amount went to compensate the artists for their denied grants and invasion of their privacy. Is it content or not? The other part of the Finley case, which is still pending, involves the decency clause. Notwithstanding then-chairman Frohnmayers assertion that he was not going to enforce the decency clause, a federal district court in California proceeded to consider whether the clause on its face was consistent with the First Amendment. In a strong and stirring reaffirmation of our basic principles of free expression, the court said: The right of artists to challenge conventional wisdom and values is a cornerstone of artistic and academic freedom Therefore, the court holds that government funding of the arts is subject to the constraints of the First Amendment. One can hope that the debate against content restrictions will be much more contained in the future. President Clinton came out strongly against content restrictions during his campaign. He has reaffirmed, in the current reauthorization cycle for the NEA, his opposition to content restrictions. Nevertheless, he is not asking Congress to delete the decency provision in the NEA statute, notwithstanding the fact that it has been declared unconstitutional by the District Court. This would have the obvious benefit of essentially mooting the decency debate. In an effort to scotch any further debate on content restrictions, to avoid a political battle, his people have said on the Hill that the decency restriction simply isnt a content restriction, as implemented by the NEA. What then is left on the constitutional front? Since the government is the patron, why cant it promulgate the rules as to who is going to get the money? After all, no artist is being denied the right to produce controversial or blasphemous art. One simply cant do it on a federal stipend. Art critic Hilton Kramer and his acolytes take that position. This issue is now focused on the federal appellate courts in the Finley appeal. It has the most profound implications to the artistic community. The central issue evolves from the Supreme Courts decision in Rust vs. Sullivan, which was the abortion gag rule case. There, the Supreme Court held in a tight five-to-four decision that it was constitutional for the government, as part of its program to support family planning clinics, to insist that doctors not advise women about an abortion option. Human Resource Development A strong human resource base to support the development of a knowledge-based economy and enhance productivity and competitiveness will be one of the key strategies in ensuring that the nation is able to face the challenges of the globalization and sustain economic growth (Ninth Malaysia Plan, 2006). Therefore, the Government will take initiatives to encourage firms to intensify the implementation of the productivity-linked wage system (PLWS) o ensure that wage movements are closely aligned with productivity. But the firms have to meet some challenges during implementation, companies are aware that PLWS is important for enhancing competitiveness. However, to ensure smooth transition of the system, there must be a strong commitment and cooperation from top management and employees. Information sharing of relevant information pertaining to the system by management is necessary to ensure the system works (Economic Report, 2004/2005). Since then certain sectors of the economy, especially plantation and construction, have received a great number of foreigner workers, and some sectors appear to be dependent on them, foreign workers were 7. 8% of the labour force in 2000 (Malaysia, 2001b). Now, Malaysia continues to remain attractive to foreign workers, the total number of registered foreign workers increased by 10. 2% to reach 1. 62 million. The majority of foreign workers are from Indonesia (69. 4%), followed by Nepal (10. 2%), India (6. 2%), and Vietnam (4. 6%), in addition, there are between 500,00 and 800,000 illegal or undocumented foreign workers in Malaysia (Hamid; Ninth Malaysia Plan, 2006). Nevertheless, especially for the manufacturing sector, the need to compete effectively in the global economy has led to observable changes in the economy. There is an increasing focus on product quality and more differentiated demand for products, resulting in shift from mass production to flexible specialisation (Economic Report, 2004/2005). There is a shift to higher value-added, less labour incentive production, even as low value-adding, labour-incentive production is moving form Malaysia to other low labour cost countries, or using foreign labour which is lower cost. So migrant workers have added to the challenge of maintaining industrial harmony, their wages are contractual, and when wages differ between the local and foreign workers, there have been disputes. Migrant workers are also from particular countries, and sometimes bring with them their inter-ethnic tensions and biases, leading to melees. As a result of labour migration, the resulting diversity of the workforce may also compound the nature of wage negotiation and contractual arrangements. In addition, there have been arguments that their presence has led to depressed wages. It has long been argued that the problems caused by migrant workers are greater than their benefits (Azizah, 1998), but the needs of business in the light of a tight labour market have always been greater priority. Thus the challenge has arisen. Conclusion In this paper, the researchers have highlighted some of the challenges for Malaysia in the light of its commitment to take growth path of globalization. These include developing a workforce with the necessary skills, equipping the existing workforce with necessary skills addressing the problems arising from the use of foreign workers, enhancing the improved worker protection. In the short run appropriate legislation needs to be put in place to allow for a diversity of working arrangements while providing adequately for worker’s protection. In the long run, there is a need to review the way education is delivered, so that schools become the great equaliser that they are meant to be by providing the entire right educational environment in which to succeed. Researchers believe that all the challenges that has been planned and predicted by the Government will be solved successfully and the labour market can become more healthy and stable.      Ã‚  Ã‚  Ã‚  Ã‚   Man's relationship to the land undergoes a transformation throughout John Steinbeck's Grapes of Wrath. Initially, back in Oklahoma, each family feels a strong attachment to the land because the ancestors of these farmers fought and cleared the Indians out of the land, made it suitable for farming, and worked year after year in the fields so that each generation would be provided for. Passing down the land to successive generations, the farmers come to realize that the land is all that they own. It is their family's source of sustenance. However, the strong bond between man and the land is broken when the bank comes to vacate the tenants during hard times.   The tractors hired by the bank literally tear down the bond between man and the land. Due to the eviction, the farmers are forced to move to California, where work is supposedly in demand. As each family takes off for California, it no longer feels a connection to the lands through which it is traveling. Once it reaches California, it feels no connection to its land. For the first time, it is forced to be dependent on somebody else's generosity in distributing jobs, and most importantly, somebody else's land. Thus, in California, the relationship between man and land is not as strong as it was in Arkansas and Oklahoma. The change in this relationship is due in part to the mercilessness of the bank, and in the end, man loses because its connection to the only significant thing it has ever owned is gone.
